WHAT PARITY GENERALLY MEANS

The federal Mental Health Parity and Addiction Equity Act generally requires many plans that offer mental-health or substance-use benefits to apply financial requirements and treatment limitations comparably to medical and surgical benefits. California law, including SB 855, provides additional protections for many state-regulated plans and policies. The exact rights and review process depend on whether a plan is regulated by the Department of Managed Health Care, the Department of Insurance, ERISA, or another system.

Keep denial letters, EOBs, plan documents, summaries of benefits, clinical records, treatment plans, authorizations, level-of-care criteria, communications, appeal submissions, and proof of deadlines. The wording of the denial and identity of the plan regulator often determine the next step.
